I was in an accident just the other day. Do I need a personal injury lawyer?
Possibly not. However, a reliable answer involves numerous considerations. Our firm offers a free personal injury consultation. We will use that time to evaluate your situation. We’ll offer our honest opinion as to whether we can help you in a way that makes you richer, rather than poorer, for having hired a lawyer.
I was in an accident just the other day. What might a lawyer do for me?
It’s important to preserve evidence with a personal injury claim. For example, if you were involved in an intersection accident the roadway may reveal tire marks that might help prove who was a fault. Those marks should be photographed. Or, regardless of how you were injured, there may be video of your accident. That evidence must be located and obtained before it is destroyed. In addition, your own auto or health insurance company may want information from you, and the negligent party’s insurer also may want to speak with you. We’ll explain what you must do, what you can do, and what you should never do. We’ll assume responsibility for dealing with these insurers. If you do not have insurance we can refer you to medical providers who will allow you to defer payment until you settle your personal injury case.
I was in an auto accident that wrecked my car. What will it cost to get a lawyer to help me get paid for that damage?
If we are retained to help you with a personal injury claim we will help you resolve your property damage claim - for free.
What will it cost to hire a lawyer to handle my personal injury claim?
You will be free to hire a lawyer on an hourly, fixed fee, or contingency fee basis. Almost everyone chooses the contingency fee. This means that the lawyer does not get paid for his time unless he facilitates a personal injury settlement, and then he gets paid a percentage of that settlement. The amount of the percentage depends on the nature of case, the extent of your injuries, the stage at which a settlement is achieved, and a host of other factors. Usually the percentage will be between 25% and 40% of the final personal injury settlement amount.
How long will it take to resolve my personal injury claim?
When insurance companies settle a personal injury case they require the injured person to sign a release. The release is a binding promise that you will never ask for more money. You usually should not attempt settlement until after you have reached “maximum medical improvement,” or MMI. Once you are at MMI your doctors can make an educated guess about the extent of any permanent impairment. That estimate will be used by your lawyer and the insurance company to evaluate your case. Sometimes people reach MMI very quickly. Sometimes it takes years.
Will there have to be a trial?
Most personal injury cases get resolved by settlement rather than trial. However, you won’t get the best possible settlement if the insurance company doesn’t believe you and your lawyer are willing to fight, and are able to fight effectively.
